Psiquiatra proibido de exercer após violar grávida de 8 meses

Juiz de instrução ordenou a suspensão da profissão a João Vasconcelos Vilas Boas suspeito de ter violado no seu consultório, na Foz, uma mulher de 30 anos grávida de 34 semanas.
O psiquiatra suspeito de ter violado durante uma consulta uma paciente em adiantado estado de gravidez foi ontem suspenso por ordem do Tribunal de Instrução Criminal do Porto de toda a actividade profissional privada ou pública. O juiz ordenou ainda que o arguido se apresente periodicamente no posto policial da área da sua residência, estando proibido de se ausentar do país.
João Vasconcelos Vilas Boas foi ouvido no TIC durante todo o dia de ontem em primeiro interrogatório judicial depois de ter sido detido pela Polícia Judiciária (PJ) anteontem. Na quinta-feira ainda foi presente ao Ministério Público e passou a noite nas celas prisionais da Polícia Judiciária. À saída do TIC nem o arguido nem o seu advogado prestaram quaisquer declarações.

Os factos remontam ao Verão passado. O médico, de 48 anos, e com consultório privado na Rua de Gondarém, na Foz, seguia há algum tempo a paciente que sofria de depressão. Terá sido nessa altura que o psiquiatra aproveitando-se do estado emocional da mulher, de 30 anos, a violou. A vítima estava grávida de 34 semanas (oito meses). Segundo fonte policial, o arguido terá mesmo recorrido à força física para conseguir os seus intentos. Manietou a paciente de forma a quer ela não pudesse resistir aos abusos.

No próprio dia, a mulher terá apresentado queixa contra o médico na esquadra da PSP e dali foi encaminhada para o Instituto de Medicina Legal do Porto onde efectuou exames médico-legais, tendo sido colhidos todos os indícios que pudessem comprovar a violação. A investigação da PJ levou depois alguns meses até à detenção mas foram determinantes os testes de ADN e os vestígios biológicos pertencentes ao agressor e encontrados na vítima.

Foi já com a investigação policial a decorrer que a mulher acabou por dar à luz a criança. Aparentemente a violação não afectou directamente a gestação mas a paciente permaneceu doente, com depressão e realizando perícias psíquicas sempre com o acompanhamento da PJ.
O crime aconteceu no consultório do médico situado numa das zonas mais conceituadas do Porto. João Vasconcelos Vilas Boas não tem antecedentes criminais mas o inquérito vai prosseguir. Embora o psiquiatra vá aguardar pela realização do julgamento em liberdade não está livre de ser condenado com pena de prisão. O Código do Processo Penal prevê para este tipo de crime uma punição entre os três e os dez anos de prisão efectiva. Tudo no entanto dependerá como decorrer a fase de inquérito e a configuração do crime a decidir pelo Ministério Público. Até lá fica impedido de exercer.

Ontem, acompanhado pelo advogado, João Vasconcelos Vilas Boas entrou como saiu: rapidamente e evitando prestar declarações sobre o assunto. À porta do TIC, três familiares do médico estavam em choque com o ocorrido e foi com alguma emoção que receberam a notícia pelo advogado sobre as medidas de coacção aplicadas pelo juiz.
